THE HONOURABLE SRI JUSTICE RAJA ELANGO CRL.A.M.P.No.1305 of 2015 & CRIMINAL APPEAL No.637 of 2015 JUDGMENT:
This appeal is filed challenging the judgment dated 01.07.2015 passed by the Special Sessions Judge for trial of cases under the S.Cs. & S.Ts.(Prevention of Atrocities) Act, Nizamabad in Spl. S.C.No.19 of 2013, whereby, the learned Sessions Judge convicted the appellant for the offences under Section 498-A IPC and Section 3(i)(xii) of Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 and sentenced him to undergo R.I. for two years under each count and to pay a fine of Rs.50,000/- under each count, in default, to undergo S.I. for six months under each count. Out of the fine amount, an amount of Rs.75,000/- was directed to be paid to victim-P.W.3 towards compensation. Both the sentences were directed to run concurrently.
When the matter is taken up for hearing, both the counsel filed Crl.A.M.P.No.1305 of 2015 stating that the parties have entered into compromise and therefore, they prayed to grant permission to compound the offence and to set aside the conviction and sentence imposed against the appellant-accused.
Both the parties as well as their counsel have signed on the petition and affidavit in Crl.A.M.P.No.1305 of 2015. The parties, who are present in the Court, also affirmed the same. A perusal of the affidavit filed in support of the petition goes to show that the matter was settled between the parties. In view of the amicable settlement of the dispute between the parties, Crl.A.M.P.No.1305 of 2015 is ordered and the compromise is recorded. Consequent thereto, the Appeal is allowed setting aside the judgment in Spl.S.C.No.19 of 2013, dated 01.07.2015 passed by the Special Sessions
Judge for trial of cases under the S.Cs. & S.Ts.(Prevention of Atrocities) Act, Nizamabad. The appellant is acquitted of the offences. The fine amount, if any, already paid by the appellant is directed to be returned to him. It is directed that this compromise shall form part of the record.
