THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.7881 of 2016 ORDER:
This Criminal Petition is filed by the petitioners-accused Nos.2 to 4 under Section 438 Cr.P.C. seeking anticipatory bail in Crime No.44 of 2016 on the file of Railway Kodur Police Station, YSR Kadapa District, registered for the offences punishable under Sections 324 and 307 r/w. 34 IPC.
Heard and perused the material available on record. The allegation against the petitioners is that they along with other accused beat the de facto complainant's husband with sticks, due to which he received bleeding injuries in connection with a betting in a cricket match.
Learned counsel for the petitioners submits that the petitioners are no way concerned with the alleged offences and that A1 and A5 were already arrested and released on bail and that the 1st petitioner is a lady and there are no previous cases pending against them. Learned Additional Public Prosecutor opposed the bail application that the injured is still in the hospital and hence, it is not a fit case to grant anticipatory bail.
In view of the submission of the learned Additional Public Prosecutor, this Court is not inclined to grant anticipatory bail to the petitioners at this stage.
Accordingly, the Criminal Petition is dismissed. ______________ RAJA ELANGO, J June 15, 2016.
