HON'BLE SRI JUSTICE C. PRAVEEN KUMAR CRIMINAL PETITION No. 1460 of 2015 ORDER:

The petitioners, who are accused Nos.2 and 3, filed the present Criminal Petition under Section 438 Cr.P.C. seeking release in the event of their arrest in connection with Crime No.58 of 2014 of Women U/G Police Station, Kadapa District, registered for the offences punishable under Sections 498-A, 506 and 384 IPC and Sections 3 and 4 of the Dowry Prohibition Act, 1961. At the time when the matter is taken up for hearing, the learned Public Prosecutor brought to the notice of the Court that earlier the petitioners moved this Court under Section 482 Cr.P.C. seeking quashing of the proceedings in the above crime.

A perusal of the order dated 03.03.2015 passed in Criminal Petition No.1242 of 2015, would show that this Court while dismissing the petition directed the petitioners to surrender before the Court concerned on or before 12.03.2015 and seek regular bail, which was directed to be disposed of on the same day on merits. In view of the orders passed by this Court, the cause in the present Criminal Petition does not survive. Having regard to the order passed by this Court in Criminal Petition No.1242 of 2015, this Criminal Petition is disposed of by directing the petitioners to surrender before the concerned Court and move an application for grant of regular bail after giving notice to the Public Prosecutor, in which event the same shall be dealt with on merits in accordance with law either on the same day or atleast by next day.
