THE HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR WRIT PETITION No.5510 of 2016 ORDER:

Heard learned counsel for the petitioner and learned Government Pleader for Revenue.

The petitioner states that she is the absolute owner and possessor of various extents of lands in different survey numbers of Komarada Village and Mandal, Vizianagaram District. She made an application, dated 09.06.2015, before the Tahsildar, Komarada Mandal, Vizianagaram District, the 4th respondent, under Form VI-A of the Andhra Pradesh Rights in Land and Pattadar Pass Books Act, 1971 (for short, 'the Act') and the Rules framed thereunder for mutation of her name in the revenue records by deleting her husband's name and paid the requisite fee to that effect. Alleging that no action is taken by the 4th respondent, the present Writ Petition is filed.

It is evident that the proceedings under Form VI-A of the Act are required to be considered in a time span of 45 days. Considering the fact that the statutory application of the petitioner is pending since 09.06.2015, the 4th respondent is directed to consider the said application and pass appropriate orders, expeditiously, preferably within a period of four weeks from the date of receipt of a copy of this order.

The Writ Petition is, accordingly, disposed of. There shall be no order as to costs.

Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
