THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM I.A.Nos. 3 and 4 of 2019 and CRIMINAL PETITION No. 3508 of 2019 ORDER:

This criminal petition is filed under Section 482 Cr.P.C. to quash the proceedings in C.C.No.451 of 2013 on the file of VIII Additional Chief Metropolitan Magistrate, Hyderabad, against the petitioners/A.1 to A.4 with respect to Crime No.78 of 2007, of Moghalpura Police Station, registered for the offences punishable under Sections 420, 468 and 471 IPC read with Sections 120-B and 409 IPC.

During pendency of this petition, the second respondent/ de facto complainant as well as the petitioners/A.1 to A.4 filed I.A.Nos.3 and 4 of 2019 seeking permission of this Court to record the compromise and for quashing the proceedings in C.C.No.451 of 2013 on the file of VIII Additional Chief Metropolitan Magistrate, Hyderabad, by stating that the matter is settled outside the Court amicably. A joint memo signed by both the parties is also filed to that effect.

Today, the second respondent/de facto complainant and the petitioners/A.1 to A.4 are present and are identified by their respective counsel. When examined, the second respondent/ de facto complainant stated that the matter has been settled

CKR, J Crl.P.No.3508 of 2019 outside the Court and he has no objection to compound the offences.

Considering the above and in view of the decision reported in Gian Singh v. State of Punjab and another1, I.A.Nos.3 and 4 are allowed and the parties are permitted to compound the offences in C.C.No.451 of 2013 on the file of VIII Additional Chief Metropolitan Magistrate, Hyderabad.

Accordingly, the Criminal Petition is allowed and the proceedings against the petitioners/A.1 to A.4 in C.C.No.451 of 2013 are hereby quashed.

As a sequel, pending miscellaneous petitions, if any, shall stand closed.
