The petitioners, who are accused in Crime No.117 of 2015 of Anantapuram Rural Police Station, Anantapuram District, registered for the offences punishable under Sections 419, 420, 468, 471 read with Section 34 I.P.C., filed this petition under Section 438 of Cr.P.C., seeking anticipatory bail. The brief facts of the case are as follows :
The de facto-complainant lodged a complaint stating that one, Sri Chinnaswamy Naidu @ Chinnaswamy purchased plot Nos.18, 19, 20 of Swetha Estates in Sy.No.3 of Papampeta Village on 21-01-1995 for Rs.12,000/-. After that, he settled at Coimbattur, thereafter he died. During his life time, he executed a Will on 21-11-2014 on his son by name Jaya Chandan, in turn the said Jaya Chandan executed Power of Attorney to look after the property in favour of the de facto-complainant. When the de facto-complainant enquired with regard to the property, he came to know that one Sri U.Sriramulu, son of Ramaiah, resident of D.No.12-4-25 of Anantapuramu forged the signature of Chinnaswamy and executed a GPA in his favour on 26-092012 by showing the Chinnaswamy photo and Identity Card and created documents. The said Sriramulu sold the said property to Venkata Reddy, S/o Pedda Narayanappa, resident of D.No.1-35, Kodimi Village, Anatapuram Rural and Govindu,
S/o G.Anjaneyulu, resident of D.No.5-803, 5th Road, Anantapuramu executed two sale documents on 15-11-2012. In turn, the said Venkata Reddy and Govind sold the said property in favour of J.Krishna, son of J.Gurrappa, resident of D.No.5-606, 5th road, Anantapuramu and U.Manjunath, son of Gangadhar, D.No.6-947, Ajadnagar, so the registered documents which was prepared by the above persons are liable for prosecution and also they tried to grab the land of the complainant.
Heard and perused the records.
In view of serious allegations against petitioners - accused, this Court is not inclined to grant anticipatory bail to petitioners - accused at this stage.
