HON'BLE SRI JUSTICE U. DURGA PRASAD RAO Writ Petition No.11060 of 2008 ORDER:

The petitioner in this writ petition seeks a direction in the nature of Mandamus declaring the action of the 1st respondent in not disposing of the statutory appeal filed by him as against the orders passed by the 2nd respondent in LTR Case No.2/VKP/2008 dated 01.03.2008 in respect of building in Sy.No.46 in an extent of Ac.0.06 cts situated in Venkatapuram Village and Mandal, Khammam District as illegal and violative of Articles 14, 21 and 300(A) of the Constitution and consequently direct the 1st respondent to dispose of the appeal.

2) As can be seen, in LTR Case No.2/VKP/2008 the writ petitioner herein appeared as 7th respondent and as per the order dated 01.03.2008, the 2nd respondent passed decree of ejectment of respondents therein from the lands in Sy.Nos.68/P, 68/P, 39/1, 75/P, 75/P, 44 and 46 to an extent of Ac.0.10 cts, Ac.0.04 cts, Ac.0.08 cts, Ac.0.021⁄2 cts, Ac.0.05 cts. Ac.0.03 cts and Ac.0.06cts respectively situated at Venkatapuram Village & Mandal and the property to be taken into Government custody for assigning the same to eligible tribals as per law in force.

3) Aggrieved by the said order, the petitioner filed LTR Appeal No.____ of 2008 and his grievance is that though a decade has passed the same has not been disposed of so far.

4) Considering the submission of learned counsel for petitioner, this writ petition is disposed of with a direction to the 1st respondent to dispose of the unnumbered LTR Appeal No._______ of 2008 preferred by the writ petitioner expeditiously not later than two (2) months from the date of receipt of a copy of this order, if the said appeal is not already disposed of.
