THE HON'BLE SRI JUSTICE M. SATYANARAYANA MURTHY WRIT PETITION No.14508 OF 2017 ORDER:

This writ petition is filed under Article 226 of the Constitution of India to quash the proceedings in Crime No.5 of 2017 of Allur Police Station, SPSR Nellore District, registered against the petitioners for the offences punishable under Sections 3(1)(v) of Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 and Section 323 read with 34 of the Indian Penal Code, 1860, on various grounds.

Learned counsel for the petitioners brought to the notice of this court the proceedings C.No.3007/C1/2018, dt. -01-2018 issued by the Deputy Inspector General of Police, South Coastal Zone, Guntur, directing the Station House Officer, Allur Police Station, to file a final report before the concerned court as the allegations made in the complaint is false. When the final report is filed, no further adjudication is necessary in the present writ petition.

In case no final report is filed treating the complaint as false, the petitioner is at liberty to renew his request at appropriate proceedings.

Accordingly, the writ petition is dismissed. . Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
