ORDER

The petitioner filed O.S.No.42 of 2021 in the Court of ll Additional District Judge (Fast Track Court-l), Khammam District, against the respondents, for partition and separate possession of the suit schedule property and for cancellation of registered partition deed bearing document No.4010 of 2016, dated 27.04.2016, and also for declaration of the registered partition deed bearing document No.12790 of 2018 dated 26.11.2018 and the registered gift deed bearing document No.14131 of 2019 dated 02.11.2019 as null and void and not binding on the petitioner. The respondents filed written statement in the suit. The suit is coming up for additional evidence of the plaintiff. However, the trial Court is said to have been adjourning the matter at the instance of respondent No.2.

2. Heard learned counsel for the petitioner and perused the I I material available on record

3. Learned counsel for the petitioner submitted that the petitioner and respondent No.1 tried to amicably settle the matter, but respondent No.2 did not agree for such settlement. At the instance of respondent No.2, the trial Court is adjourning the matter. The petitioner, who is aged about 73, and respondent No.1, aged about 92, are suffering \ \

/\ from old age ailments. Learned counsel seeks a direction to the trial Court to dispose of the suit within a period of three months.

4. ln view of innocuous relief sought in this revision, notice to the respondents is disPensed with.

5. Considering the age of the petitioner and respondent No'1, who are about 73 years and 92 years respectively, the civil revision petition is disposed of with a direction to the ll-Additional District Judge (Fast Tract Court-l), Khammam District, to dispose of O'S'No'42 of 2021 within a period of three (03) months from the date of receipt of a copy of this order. lf respondent Nos.1 to 4 have any grievance with regard to the order passed herein, they are at liberty to seek modification of this order. No order as to costs.
