HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.6764 OF 2017 ORDER:

The writ petition is filed seeking to declare the action of respondents 2 and 3 in not taking action against the 4th respondent in removing the encroachment of petitioners' house plot baring No.1 situated in Sy.Nos.305/3 and 306/3 an extent of 333.41 Sq. yards situated at Kallur village fields, Kurnool Town, Kurnool District, in spite of petitioners' representations including the 3rd respondent report, dated 23-11-2014 and letter vide Dis.G.C.No.1/2015, dated 05-05-2015 issued by the Assistant Director, District Survey and Land Records, Kurnool, confirming the 4th respondent encroachment, on the ground, O.S.No.

69 of 2015, pending on the file of VI Additional District Judge, Kurnool, which is illegal and arbitrary and consequential direction to the respondents 2 and 3 to remove the illegal encroachment of the 4th respondent and take action, as per law. Considering the fact that O.S.No.69 of 2015, filed by petitioners, is pending on the file of the VI Additional District Judge, Kurnool, it is open for the petitioners to approach the learned VI Additional District Judge, seeking to dispose of the said suit at the earliest and which application shall be considered, in accordance with law.

Accordingly, the writ petition is closed. There shall be no order as to costs.

Miscellaneous Petitions pending, if any, in this writ petition shall stand closed.
