Heard learned counsel for the petitioner and learned Government Pleader for Home.

The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of the respondents in not disposing of the application made by the petitioner for renewal of gun licence vide application proceedings No. C3/3469/2007, dated 25.07.2007, as illegal, arbitrary and violative of principles of natural justice; and consequently to direct the respondents to dispose of the application.

The averments in the affidavit filed in support of the writ petition would show that due to threat from the naxalites, he applied for gun licence and the respondents have granted gun licence on 09.07.1986 vide proceedings No.141/35, which was being renewed from time to time. It is stated that he purchased a 12 Bore D.B.B.L.Gun No.7195-80 for his protection. As the gun licence got expired, he made an application on 17.07.2007 for renewal of gun licence by depositing the weapon with M/s. Moin Arms and Ammunition Factory vide receipt No. RR/4311, dated 08.01.2007. It is stated

that though he made an application for renewal in the month of July, 2007, till date no orders are passed. Hence, the writ petition.

Without going into the merits of the case and having regard to the facts and circumstances stated above, the writ petition is disposed of advising the respondents to pass appropriate orders on the representation dated 17.07.2007 made by the petitioner for renewal of gun licence for the period of 2007-2010, in accordance with law, as early as possible, preferably within a period of ten

(10) weeks from the date of receipt of a copy of the order, if the same is still pending.

There shall be no order as to costs. Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
