THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION Nos.33314, 33338 and 33339 of 2017 COMMON ORDER:

These three Writ Petitions are being disposed of by this common order as they relate to the challenge of seizure of rice and oil from the mill and shops of the petitioners. It is an admitted case that pursuant to the seizure of the goods, 6A proceedings were taken up and they are pending before the second respondent. Though the petitioners filed applications seeking release of the seized stock, but in view of the condition imposed for furnishing bank guarantee to the full value of the goods and their inability to comply with the said condition, they seek early disposal of the 6A proceedings. Since the goods which were seized are not perishable, the competent authority can keep the goods pending disposal of the main 6A proceedings.

In the circumstances, the second respondent is directed to dispose of the pending 6A proceedings as expeditiously as possible, but not later than three months from the date of receipt of a copy of this order, and pending disposal of the said proceedings, the seized goods shall not be sold or disposed of in any other manner. The seizure of goods shall be subject to the final orders to be passed by the second respondent.

The Writ Petitions are, accordingly, disposed of. The miscellaneous petitions pending in these Writ Petitions, if any, shall stand closed. There shall be no order as to costs. ________________________________ (A.RAMALINGESWARA RAO, J) 05.10.2017 vs
