THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.20285 of 2016 ORDER:

The petitioner seeks a direction to respondent Nos.2 to 5 not to interfere in respect of his land admeasuring 3865 sq.mts. in Sy.No.97/1 (97/1B) of Gosala Village, Penamaluru Mandal, Krishna District.

Respondent No.3 issued notification dated 22.03.2016 calling for objections, under Section 3-A(1) of the National Highways Act, 1956 (for short 'the Act'), to acquire the lands mentioned in the schedule, including the land of the petitioner. Petitioner filed his objections on 03.06.2016. The grievance of the petitioner is that the respondents without passing any orders on his objections have already demolished the compound wall. Aggrieved by the same, the present Writ Petition is filed by the petitioner. Heard the learned Counsel for the petitioner and learned Assistant Government Pleader for Revenue.

On instructions, learned Assistant Government Pleader for Revenue submits that the objections of the petitioners are under consideration by the competent authority.

In the circumstances, the Writ Petition is disposed of directing the respondents not to dispossess the petitioner from the subject land without following the procedure prescribed under the Act.
