THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.10506 of 2010 ORDER:

This writ petition was filed challenging the action of respondents in calling upon the petitioner to remit the payment of short levy of stamp duty on lease deed of Bar premises vide notice dated 23.03.2010.

This Court while ordering notice before admission on 30.04.2010 held that the petitioner cannot avoid payment of deficit stamp duty when the concerned authority found that the document was not properly stamped and accordingly, granted six weeks time. If the petitioner has paid the amount pursuant to the said order, nothing survives for consideration in the writ petition and the writ petition has become infructuous.

Accordingly, this writ petition is dismissed. No order as to costs. Miscellaneous Petitions, if any, pending in this writ petition shall stand closed.
