THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.26298 of 2012 ORDER:
The petitioner is a Church situated at Trimulgherry, Secunderabad. Its grievance is that the Station House Officer, Trimulgherry Police Station, Cyberabad, was interfering with its day-today affairs and also on Sunday under the influence of the 2nd respondent.
The Inspector of Police, Trimulgherry Police Station, Secunderabad, filed a counter-affidavit stating that Crime No.88 of 2012 was registered under Section 107 Cr.P.C., on the file of the Trimulgherry Police Station, upon the complaint lodged by the SubInspector of Police, Trimulgherry Police Station, owing to the congregation of rival groups at the Church premises causing breach of peace and tranquillity. It is in the context of this crime that the police personnel were stated to have visited the Church. The Inspector of Police stated that except for the above, there was no interference by the police authorities in day-to-day affairs of the petitioner - Church and even on Sunday. He also denied the allegation of the petitioner that at the behest of the 2nd respondent, the police authorities were interfering in the matter.
Though this counter-affidavit was filed on 06.09.2012, no reply affidavit has been filed rebutting the averments made therein. The stand of the police authorities is taken on record. In the light thereof, no interference is warranted in this writ petition. The writ petition is accordingly dismissed.
Pending Miscellaneous Petitions shall also stand dismissed. No order as to costs.
