Heard learned counsel for the petitioner and learned Government pleader for Revenue (TG).

Petitioner claims that he succeeded land to an extent of Ac.1.50 cents in R.S.No.52 of Koniki Village, Pedapadu Mandal, West Godavari District. Alleging that the Gram Panchayat is undertaking construction of two buildings on 600 Square yards in the land belonging to him, he filed W.P.No.5431 of 2018. In the said writ petition, petitioner claimed that the subject land belongs to him and therefore, no construction can be made by the Gram Panchayat. This Court by order dated 20.02.2018 granted interim order of status-quo to be maintained and the said writ petition is pending.

Learned counsel for the petitioner submits that application to conduct survey was filed and alleging that there is no action on the application filed by the petitioner this writ petition is filed to direct the respondents for conducting of survey. 4.

As noted above, since petitioner has serious grievance against Gram Panchayat undertaking construction of two buildings on the land claimed by him as owned, he filed W.P.No.5431 of 2018 and the same is pending. If petitioner has any other grievance on the same issue, he could have filed appropriate petition in the pending writ petition but cannot go on multiplying the litigation on the same subject property by instituting independent writ petitions. It cannot be said that the prayer to

- 3 - conduct survey is an independent grievance and does not flow out of earlier grievance of the petitioner which is the subject matter of W.P.No.5431 of 2018.

Thus, leaving it open to the petitioner to work out his remedies, the Writ Petition is dismissed. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
