THE HON'BLE SRI JUSTI CE M.S.K. JAI SWAL WRI T PETI TI ON No.16104 of 2006 ORDER:

On behalf of the petitioners, during course of hearing, it is fairly submitted that the issued involved in the present writ petition is squarely covered by the common judgment of the Division Bench of this court in W.A.No.1812 of 2003 and batch, dated 20.07.2010. It is further submitted that following said decision, similar matters, viz., W.A.Nos.72 of 2004 and batch and W.P.Nos.17113 of 2006 and batch were also dismissed, vide common judgment, dated 26.08.2010. Therefore, the learned counsel requested that the present writ petition may also be dismissed in terms of the said judgment.

Having carefully perused the said common judgment, I am satisfied that the petitioners raised the issue, which is identical to the issue raised in the batch of writ appeals and writ petitions, stated supra, and that the said common judgment squarely covers the issue raised in the present writ petition.

In view of the above, this writ petition is also dismissed in terms of the said common judgment in W.A.No.1812 of 2003 and batch, dated 20.07.2010. No order as to costs.

Pending miscellaneous petitions, if any, shall stand closed in consequence.
