THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.32505 of 2016 ORDER:

This writ petition is filed seeking a writ of Mandamus declaring the action of the respondents 2 to 5 in not considering the representations of the petitioner-society dated 18.07.2016 and 20.08.2016 as illegal and arbitrary.

Heard Sri C.Hari Preeth, learned counsel for the petitioner, the learned Government Pleader for fisheries (Telangana), representing the respondents 1 to 4 and the learned Government Pleader for Home (Telangana) representing the 5th respondent. The petitioner is a Fishermen Cooperative Society registered under the provisions of Cooperative Societies Act on 02.02.2016. The third respondent granted fishing rights in favour of the petitioner's society in respect of Rampur Village of Buthkur Gram Panchayat of Kadam Mandal, Adilabad District. As per the orders of the third respondent, the petitioner's society was granted fishing rights on Godavari river. The grievance of the petitioner is that the sixth respondent society is interfering with the fishing rights of the petitioner-society. The petitioner society submitted a representation to the third respondent on 18.07.2016 and 20.08.2016 with a request to take appropriate action against the 6th respondent. For one reason or other, the third respondent has not disposed of the representation of the petitioner.

At the time of arguments, the only relief sought by the learned counsel for the petitioner is to direct the third respondent to dispose of the representations of the petitioner society dated 18.07.2016 and 20.08.2016. The learned Assistant Government Pleaders also consented for the same.

In view of the submissions made by the learned counsel for the petitioner, this Court is not inclined to go into the merits of the main case.

Having regard to the submissions made by both the counsel, the third respondent is hereby directed to dispose of the representations of the petitioner society dated 18.07.2016 and 20.08.2016 as expeditiously as possible, preferably, within a period of six weeks from the date of receipt of a copy of this order. With the above direction, the writ petition is disposed of. No order as to costs. As a sequel, the miscellaneous petitions, pending if any in this writ petition, shall stand closed. ______________________ T.SUNIL CHOWDARY, J September 23, 2016.
