THE HON'BLE SRI JUSTICE SANJAY KUMAR AND THE HON'BLE SRI JUSTICE N. BALAYOGI WRIT PETITION No. 10033 of 2017 ORDER: (per Hon'ble Sri Justice Sanjay Kumar) The petitioner is the applicant in O.A.No.4276 of 2016 on the file of the Andhra Pradesh Administrative Tribunal, Hyderabad. By way of the said O.A., he sought to challenge G.O.Rt.No.747 dated 07.11.2016 whereby he was placed under suspension pending disciplinary proceedings. By order dated 16.03.2017, the Tribunal dismissed the O.A. Hence, this writ petition. Sri Pratap Narayan Sanghi, learned counsel for the petitioner, would contend that the petitioner was placed under suspension in November, 2016, in relation to an instance which occurred in November, 2014. He would further state that the petitioner is slated to retire from service in May, 2017.

Disciplinary proceedings were initiated against the petitioner and he was placed under suspension in relation thereto under G.O.Rt.No.747 dated 07.11.2016. As the authorities concerned are yet to look into the allegations levelled against the petitioner, we find no ground to interfere with the suspension of the petitioner pending finalisation of such disciplinary proceedings. However, as we are informed that the petitioner made representation dated 09.11.2016 to the Commissioner and Director of Agricultural Marketing, Government of Andhra Pradesh, in relation to his being continued under suspension at the fag end of his service, the writ petition is disposed of directing the authorities concerned to consider the said representation in accordance with law and pass appropriate orders thereon.

completed expeditiously and, in any event, not later than three weeks from the date of receipt of a copy of this order. Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. No order as to costs.
