HONOURABLE JUSTICE G. SRI DEVI CRIMINAL PETITION No. 3381 of 2019 ORDER:

This Criminal Petition is filed under Section 482 Cr.P.C. seeking quashing of the proceedings in C.C.No.757 of 2019 on the file of the XII Additional Chief Metropolitan Magistrate, Hyderabad. 2.

A charge sheet came to be filed against the petitioner/ accused No.3 and others for the offences punishable under Sections 406, 420 IPC and Sections 3 and 4 of the Prize Chits and Money Circulation Schemes (Banned) Act, 1978.

Though the present Criminal Petition is filed seeking quashing of entire proceedings, but learned counsel for the petitioner restricts his prayer seeking dispensation of the presence of the petitioner before the trial Court on every date of adjournment.

The learned Public Prosecutor submits that since the identity of petitioner is not in dispute, his presence in the above C.C. may not be necessary on every date of adjournment.

Having regard to the facts and circumstances of the case, the personal appearance of the petitioner in C.C.No.757 of 2018 on the file of the XII Additional Chief Metropolitan Magistrate, Hyderabad, is hereby dispensed with except on the dates when his presence is specifically required by the Court. The petitioner shall be represented by his counsel.

With the above direction, the Criminal Petition is disposed of. As a sequel thereto, Miscellaneous Petitions, if any, pending in this Criminal Petition, shall stand closed.
