THE HONOURABLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.12534 OF 2019 DATED :02.07.2019 Between :
Challuri Krupakar Reddy, S/o.Late C.Narsimha Reddy, Aged 54 yrs, Occu : Agriculture, R/o.H.No.16-10-27/110/E, Municipal Colony, Malakpet, Hyderabad 500 036, ..
Petitioner And The State of Telangana, Rep., by its Principal Secretary, Secretary (Revenue Department), Secretariat Buildings, Hyderabad & others.
.. Respondents This court made the following :
- 2 - THE HONOURABLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.12534 OF 2019 ORDER :
Heard learned counsel for the petitioner and learned Government Pleader for Revenue.
2.
Petitioner as well as 3rd respondent are claiming property to an extent of Ac.2-22 guntas in Sy.No.400 and Ac.1-21 guntas in Sy.No.401 of Pedda Amberpet Village, Hayatnagar Mandal, Ranga Reddy District, standing in the name of mother of petitioner. Petitioner claims to have submitted application in Form VI-A on 20.06.2019 to mutate his name in the revenue records. It appears, 3rd respondent made an application to mutate her name in the revenue records. In response to the said application, notice dated 16.05.2019 was issued and notice was placed on the notice board. Having come to know of such application, petitioner filed representation to the Tahsildar dated 04.06.2019 narrating his stand and requesting to mutate his name.
3.
Apparently, it is seen from the material on record that application submitted by petitioner is later to the application submitted by 3rd respondent. Prima-facie, the action initiated by the Tahsildar in issuing notice to enquire cannot be faulted. 4.
Be that as it may, petitioner claims to have filed objections before the Tahsildar on 18.06.2019. If no final decision is made by this date, it is open to the petitioner to file his objections in response to notice dated 16.05.2019 within two weeks. If such objections are received and no decision is already made, the said
- 3 - objections be considered while processing the application submitted by 3rd respondent. If prima-facie, the Tahsildar agrees with the objections of petitioner, he shall put on notice the 3rd respondent, afford due opportunity, take a decision and communicate the same to the petitioner and 3rd respondent. 5.
With the above directions, the Writ Petition is disposed of. Pending miscellaneous petitions, if any, shall stand closed. __________________ P.NAVEEN RAO,J 2nd July, 2019 Note :
