Heard learned counsel for the petitioner and learned Government Pleader for Revenue appearing for the respondents. 2.

Petitioner claims that he succeeded to land admeasuring Acs.10.00 of Paloncha Revenue Village and Mandal, Bhadradri Kothagudem District, from his grandfather, by name, Sikka Narsimhulu. Petitioner claims to have submitted an application for conducting survey over the subject land, as there is threat of encroachment by the neighbours.

Material on record would disclose that the revenue records reflect the name of Sikka Narsimhulu and so far petitioner has not applied for mutation of his name in the revenue records. Thus, at this stage, it is premature for the petitioner to submit an application for conducting survey even before he applies for mutation of his name in the revenue records.

The Writ Petition is accordingly dismissed leaving it open to the petitioner to submit application for mutation of his name in the revenue records with supporting documents and thereafter take further course of action as warranted by law. There shall be no order as to costs.

Miscellaneous Petitions, if any, filed in this Writ Petition shall stand closed.
