BALAYOGI WRI T PETI TI ON No. 2483 of 2017 ORDER: (per Hon'ble Sri Justice Sanjay Kumar) The petitioners are the applicants in O.A.No.10202 of 2009 on the file of the Andhra Pradesh Administrative Tribunal, Hyderabad. After the abolition of the Tribunal insofar as the State of Telangana is concerned, the said O.A is kept pending. While so, they filed the present writ petition seeking adjudication of the disputes raised by them in the said O.A. The matters which come before this Division Bench arise out of the orders passed by the Administrative Tribunal. However, in the present case, orders are yet to be passed by the Tribunal and in the light of the subsequent development, no order can ever be passed in the said O.A by the Tribunal.
That being so, Sri P. Lakshmana Rao, learned counsel for the petitioners, seeks liberty to withdraw O.A.No.10202 of 2009 filed by his clients before the Andhra Pradesh Administrative Tribunal, Hyderabad, reserving liberty to them to seek reddressal of their grievances raised in the said O.A before the appropriate forum in accordance with law. As we are now informed that service disputes relating to employees of the State of Telangana are being brought before this Court by way of writ petitions, which are listed before the concerned learned Single Judges, we are of the opinion that the petitioners can be permitted to seek withdrawal of the pending O.A.
O.A.No.10202 of 2009 is accordingly dismissed as withdrawn and liberty is granted to the petitioners to seek redressal of the grievances
canvassed by them in the said O.A by way of independent proceedings before the appropriate forum in accordance with law. Office is directed to communicate a copy of this order to the Andhra Pradesh Administrative Tribunal, Hyderabad, which is still seized of the records relating to O.A.No.10202 of 2009 for its intimation and record. The writ petition is accordingly disposed of. Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. No order as to costs.
