THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO. 3212 OF 2022 O R D E R:

This Criminal Petition is filed under Section 438 of Cr.P.C. seeking pre-arrest bail to the petitioner/accused No.4, in the event of his arrest in connection with Crime No.76 of 2020 on the file of the C.C.S.Police Station, Hyderabad, registered for the offences punishable under Section 406 and 420 Indian Penal Code. 2.

Learned Counsel for petitioner submits that notice under Section 41-A Cr.P.C. was already issued, however, the police are harassing the petitioner.

Heard learned Assistant Public Prosecutor for the respondentState. 4.

Since it is stated by the learned counsel for petitioner that notice under Section 41-A of Cr.P.C was already issued, however, police are harassing the petitioner and since the punishment prescribed for the offences alleged against the petitioner is up to seven years, without going into merits of the matter, respondent - Police are directed to strictly follow the procedure as contemplated under Section 41-A Cr.P.C and the guidelines formulated by the

Hon'ble Supreme Court in Arnesh Kumar v. State of Bihar1 scrupulously. It is needless to say, any deviation in this regard will be viewed seriously.

The Criminal Petition is accordingly, disposed of. 6.

Miscellaneous applications pending, if any, in this criminal petition, shall stand closed.
