THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY CRIMINAL PETITION No.7335 OF 2014 ORDER:

1 This petition is filed under Section 482 Cr.P.C seeking to quash the proceedings against the petitioners/accused Nos.2 to 6 in C.C.No.77 of 2012 on the file of Special Mobile Court, Kadapa (Formerly C.C.No.577 of 2011 on the file of the Court of the I Additional Judicial Magistrate of I Class, Kadapa). 2 At the time of arguments, the learned counsel for the petitioners seeks permission of the Court to permit the petitioners to withdraw the petition with a liberty to avail the remedies available to them under law, including filing of a petition for discharge before the trial Court. The learned counsel for the petitioners further requested this Court that the presence of the petitioners may be dispensed with before the trial Court for each and every adjournment. Permission accorded.

3 There is no dispute with regard to the identity of the petitioners. Even if the presence of the petitioners is dispensed with, no prejudice will be caused to the 2nd respondent.

4 In the result, the Criminal petition is dismissed, granting the liberty as prayed for. The presence of the petitioners / accused Nos.2 to 6 in C.C.No.77 of 2012 on the file of the Special Mobile Court, Kadapa (Formerly C.C.No.577 of 2011 on the file of the Court of the I Additional Judicial Magistrate of I Class, Kadapa) is hereby dispensed with for each and every adjournment. However, they shall appear before the said Court as and when their presence is so required. As a sequel, the miscellaneous petitions, pending if any in this Criminal Petition, shall stand closed.
