O R D E R

The case of the petitioners is that they have agricultural lands in Kalivelapalem village and for irrigation, they depend on water source from Kalivelapalem cheru (tank), which is in an extent of Acs.1260-00 cents in Sy.No.86-A and 860-B of Kalivelapalem village, Kakupally Bit-1, Nellore Rural Mandal, SPSR Nellore District. Their further case is that as some persons in the village encroached the tank, storage level decreased and thereby causing hardship for irrigation of their lands. Therefore, they made a representation dated 1.12.2016 to respondents 4, 5 and 8 i.e., Revenue Divisional Officer, Tahsildar and Superintending Engineer, Irrigation Circle, Nellore. Aggrieved by their inaction in taking any steps for removing the encroachments on the subject tank, the present writ petition has been filed. Heard the leaned counsel for the petitioners. The learned Assistant Government Pleader for Irrigation submitted that as there are encroachments on the subject tank, the authorities are taking action in accordance with law to remove such encroachments.

Having regard to the facts and circumstances and the submissions of the learned counsel, without going into the merits of

the case, the writ petition is disposed of at the stage of admission directing the 5th respondent - Tahsildar and the 8th respondent - Superintending Engineer, to take necessary action in accordance with law on the representation of the petitioners dated 1.12.2016. No costs.
