Kurlkala Rajeshwar Rao S/o Venkat Rama Rao Aged 66 years Occ Cultivation R/o Prem Nagar Colony Naimnagar Village Hanumakonda District Warangal Petitioner And The State of Telangana being rep by its Chief Secretary Secretariat Buildings Saifabad Hyderabad & others Respondents The Court made the following:

ORAL ORDER:

Heard learned counsel for petitioner and learned Government Pleader for Revenue.

2.

According to petitioner huge extent of Ac. 522 out of Ac.644, Jakkaram village, Mulugu taluq, District Warangal leased to his family was acquired by forest department. On culmination of the forest proceedings, Government issued orders in G.O.Ms.No. 1434 dated 26.7.1958 to allot extent of land mentioned therein to the father of petitioner. This writ petition is filed alleging that said orders are not implemented, causing hardship to the family of petitioner. A legal notice dated 13.3.2019 was issued and alleging no response to the said legal notice, this writ petition is filed.

3.

As briefly noted above, even assuming that a right vests with the father of petitioner, petitioner is seeking implementation of the orders of the Government in G O Ms No. 1434 dated 26.7.1958 after lapse of about 61 years and no reasons are assigned in the affidavit filed in support of the writ petition as to why petitioner or his father did not avail the remedies seeking implementation of the said orders of the Government and kept quiet so long. Mere issuance of a legal notice dated 13.3.2019 and no response for the same, is not a good ground to institute the writ petition after such a long time. Even assuming that there is a valid claim in favour of the family of petitioner, the said claim itself is hit by inordinate delay and latches. Accordingly, the writ petition is dismissed. Miscellaneous petitions, if any pending, are closed. __________________ P NAVEEN RAO,J DATE:24-6-2019 TVK
