This Criminal Petition is filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') for grant of pre-arrest bail to the petitioner, who is arrayed as accused No.9 in Crime No.723 of 2021 on the file of Keesara Police Station, Jawaharnagar Division, Malkajgiri District, registered for the offences punishable under Sections 419, 420, 406, 464, 467, 468 and 471 read with 120 (B) of I.P.C. 2.
Heard Sri E.Venkata Siddhartha, learned counsel for the petitioner-accused No.9 and Sri M.Ramachandra Reddy, learned Additional Public Prosecutor appearing for the respondent-State.

The case of the prosecution is that on 10.11.2021 the learned XVII Additional Metropolitan Magistrate, Cyberabad
at Malkajgiri received a petition from the complainant, wherein she stated that she purchased the land through registered sale deed on 15.04.1991. It is further stated that her daughter late Gaddam Suguna marriage was performed with one Gopal in 1981 and she died in 1998 leaving behind her children. In the month of November, 2020, husband of the deceased and others came to the complainant's house and quarreled with her demanding share in the said self acquired property and cheated the complainant with active involvement of Shaik Hamar and Annam Srinivas Reddy and created a false sale deed by impersonation and sold the said property to one Swathi Reddy. Hence, requested the police to take necessary action. Basing on the same, police registered a case for the aforesaid offences. 4.
Learned counsel for the petitioner/Accused No.9 would submit that initially the name of the is not mentioned, but subsequently his name was mentioned in the remand report. The contention of the petitioner is that he is no way concerned with the alleged offence and he has been falsely implicated in this case. Even according to the prosecution case, there is no allegation against the petitioner to attract the offence under Section 467 of IPC and the crime is of the year 2021 and entire investigation is completed. He further submits that A.12
to A.3 were released on bail and hence, he requested the Court to grant Anticipatory bail to the petitioner. 5.
On the other hand, learned Additional Public Prosecutor opposed the same and submits that the allegation levelled against the petitioner is severe in nature and hence, he prays to dismiss the petition.

Considering the submissions made by the learned counsel for both parties and upon perusal of the material available on record, it appears that the crime is of the year 2021. The allegation against the petitioner is that he introduced A.1 to A.10 to facilitate him to use fabricated documents. Considering the same and also crime is of the year 2021, this Court is inclined to grant bail to the petitioner/Accused No.9 subject to the following conditions:
(i) The petitioner-accused No.9 shall surrender before the Keesara Police Station, Rachakonda Commissionerate within two (2) weeks from today, and on such surrender, the petitioner shall be released on bail on executing a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties for a like sum each. (ii) On such release, the petitioner - accused No.9 shall appear before the concerned Investigating Officer on every Wednesday between 09:00 a.m, and 05:00 p.m., for a period of eight (8) weeks or till filing of the charge sheet, whichever is earlier, and thereafter, as and when required.
(iii) The petitioner-accused No.9 shall abide by the other conditions stipulated in Section 482(2) of the
Bharatiya Nagarik Suraksha Sanhita, 2023 and cooperate with the Investigating Officer in investigating the case.

Accordingly, the Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
