O R D E R
This Criminal Petition is filed under Sections 480 & 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') by the petitioner/Accused No.1 seeking to enlarge him on bail in S.C. No.387 of 2023 on the file of learned Special Sessions Judge for Trial of Offences under SCs&Sts (POA) Act-cum-VII Additional District and Sessions Judge, Ranga Reddy at L.B.Nagar. The offences alleged against the petitioner is punishable under Section 302, 201 read with 109, 202 of I.P.C. and Section 3 (2) (V) of the SCs/STs (POA) Amendment Act, 2015.

The brief facts of the case are that on 24.02.2023, the petitioner voluntarily surrendered before the Abdullapurmet police and stated that as the deceased was interfering in his love life with his girl friend, he murdered the deceased by taking him to the nearby bushes at the outskirts of Pedda Amberpet Municipality on 17.02.2023. Hence, a case was registered vide Crime No.119 of 2023 before the Abdullapurmet Police, Vanasthalipuram and after completion of the investigation, a charge sheet was filed vide S.C.No.387 of 2023 on the file of the Special Sessions Judge for Trial of Offences under SCs & STs (POA) Act-cum-VII Additional District and Sessions Judge, Ranga Reddy District at L.B.Nagar, for the offences punishable under Sections 302, 201 read with 109, 202 of the IPC and Section 3 (2) (V) of SCs &STs (POA) Act.

Heard Sri P.Prabhakar Reddy, learned counsel appearing for the petitioner as well as Sri M.Ramachandra Reddy, learned Additional Public Prosecutor appearing for the respondent-State.

Learned counsel for the petitioner would submit that the petitioner has been in judicial custody since
- 3 - 24.02.2023, which has caused difficulty in appearing for his B.Tech semester examinations. He further submitted that the petitioner was earlier granted interim bail to attend the examination for his I and II year semesters by order dated 18.12.2024 passed in Crl.P.No.15028 of 2024. He further contended that the petitioner now needs to appear for his III year B.Tech I and II semester supplementary examinations, which commended on 16.04.2026 to 30.04.2026 and that he has already missed for one examination and that the petitioner is willing to furnish sureties as directed by this Court. Hence, he prayed that the Court grant interim bail to the petitioner for the purpose of attending his B.Tech supplementary examinations.

Learned Additional Public Prosecutor has not opposed the same of granting interim bail to the petitioner for enabling him to appear for his B.Tech Supplementary Examinations.

Considering the submissions made by both parties, and in view of the fact that the III year B.Tech I and II Semester supplementary examinations of the petitioner were scheduled from 16.04.2026 to 30.04.2026, and that the
- 4 - petitioner has already missed one examination held on 16.04.2026, this Court is inclined to grant interim bail to the petitioner from 18.04.2026 to 30.04.2026, subject to the following conditions.
(i) The petitioner shall be released on interim bail from 18.04.2026 to 30.04.2026 subject to execution of personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties for a like sum each to the satisfaction of the Jail Superintendent.
(ii) The petitioner shall surrender before the concerned Jail Superintendent on 01.05.2026.
(iii) The concerned Jail Superintendent is directed to ensure that this order is complied forthwith. (iv) The petitioner shall abide by the conditions stipulated in Section 437 (3) of Cr.P.C. (Presently Section 480 (3) of the BNSS).
(v) Registry is directed to communicate this order to the concerned Jail Superintendent.

Accordingly, the Criminal petition is allowed. Miscellaneous petitions, if any, pending shall stand closed.
