THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL REVISION CASE No.1727 of 2016 ORDER:

1.

This Criminal Revision Case is filed by the petitioner-A3 aggrieved by the docket order dated 20.4.2016 passed in C.C.No.102 of 2014 by the III Special Magistrate, Hyderabad.

2. In the above C.C., the petitioner along with other accused was tried for the offence under Section 138 of the Negotiable Instruments Act. The trial Court convicted the petitioner and other accused for the offence under Section 138 of the Negotiable Instruments Act on 20.4.2016. But as the accused were absent on that day, the trial Court without passing any sentence, issued NBWs against the accused in the above C.C. Aggrieved by the issuance of NBWs, the petitioner filed this revision.

3. Heard and perused the material available on record.

4. Considering the facts and circumstances of the case, this Court is inclined to pass the following order:

"The petitioner-A3 is directed to appear before the trial Court and file an application seeking to recall NBWs issued against him. On such application being filed, the trial Court is directed to recall NBWs issued against the petitioner. It is made clear that this order will not stand in the way of pronouncement of judgment including the judgment convicting the petitioner and sentencing him with imprisonment and fine."
