THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI WRIT PETITION No.10567 of 2017 ORDER:

In this Writ Petition, under Article 226 of the Constitution of India, the petitioner challenged the action of respondent No.3 in calling her to the police station at the instance of respondents 4 and and directing her to vacate the house property bearing No.2-1-864 situated at Laskhar Singaram, Hanmakonda, Warangal Urban District and causing interference to her life and personal liberty.

Learned counsel appearing for the petitioner would submit as follows:

" The subject property belongs to deceased husband of the petitioner. She was given employment in the department of her husband on compassionate grounds. Her husband got the property towards his share in a family partition. After the death of her husband, the petitioner gifted the said house property to her daughter, who is a minor. She is living along with her minor daughter in the subject house. The police are interfering in a civil dispute. Hence, the writ petition is filed." 3.

Learned Government Pleader for Home on written instructions, which are placed on record, would submit that the 4th respo5ndent is the mother-in-law of the petitioner; she lodged a report with the Commissioner of Police; the same has been forwarded to the 3rd respondent-Station House Officer Hanmakonda, Warangal Urban District; Only for the purpose of enquiry, the petitioner was called only once to the police station;

all the contrary allegations in the writ petition are false and invented; and the writ petition is intended to prevent the police from taking any action against her in accordance with law, in the event a crime is registered pursuant to the report lodged by the 4th respondent.

Recording the aforesaid submissions, the writ petition is disposed of directing the 3rd respondent not to call the petitioner to the police station, unless her presence for any enquiry is absolutely necessary pursuant to a crime, if any, registered, in accordance with the procedure established by law.
