Heard learned counsel for the petitioner and learned Government pleader.

Petitioner claims that he is an ex-serviceman and land to an extent of Ac.4-60 cents in Sy.No.1277/2, Ramasamudram Village, Porumamilla Mandal, YSR Kadapa District was allotted to him under the ex-servicemen Land Allotment Scheme. This allotment was made in the year 2004. As per the policy of Government, an ex-serviceman can alienate the land allotted to him after ten years of the date of assignment. As petitioner is in need of money, he intend to sell and when he presented the deed of conveyance, the same was rejected on the ground that the land is included in the list of prohibited properties under Section 22-A of the Indian Registration Act. Therefore, petitioner applied to the District Collector to exclude the land from the list of prohibited properties. In response to the application filed by the petitioner, the District Collector addressed letter to the Tahsildar, Porumamilla, on 08.03.2018 calling for his report on the claim made by the petitioner. Alleging inaction on the application filed, this writ petition is filed.

Since the application was already submitted by the petitioner on 03.01.2018 and the same is pending consideration, this Court is not inclined to entertain the writ petition and keep the writ petition pending.

Having regard to the above, the Writ Petition is disposed of directing the District Collector, YSR Kadapa District to examine the

- 3 - claim of petitioner by obtaining report from the Tahsildar, as per letter addressed by him on 08.03.2018 and pass appropriate orders, as warranted by law, as expeditiously as possible, preferably within a period of six (6) weeks from the date of receipt of copy of this order. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
