THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No. 5747 of 2016 ORDER:

The grievance of the petitioner is with regard to the show cause notice dated 19.11.2015 issued by the District Collector, Kurnool, whereunder the caste certificate of the petitioner was proposed to be cancelled.

2. Sri G. Ravi Mohan, learned counsel for the petitioner, would state that though the copy of the show cause notice has been received by the petitioner, the report of the District Level Scrutiny Committee, Kurnool, which is adverted to therein, has not been provided.

3. As the petitioner would necessarily have to examine the contents of the report and respond thereto comprehensively, it is not open to the District Collector, Kurnool District, to keep the said report confidential.

There shall accordingly be a direction to the District Collector, Kurnool, to furnish a copy of the report of the District Level Scrutiny Committee, Kurnool District, to the petitioner within one week from the date of receipt of a copy of this order. The petitioner shall submit his explanation within two weeks thereafter and the matter may then be considered by the District Collector, Kurnool District, in accordance with law. The Writ Petition is disposed of with the above direction. Pending miscellaneous petitions shall stand closed in the light of this final order. No order as to costs.
