THE HON'BLE SRI JUSTICE P.KESHAVA RAO WRIT PETITION No.34274 OF 2015 ORDER:

There is no representation on behalf of the petitioners. The prayer sought for in the writ petition is as under: " to issue a Writ Order or Direction more particularly one in the nature of WRIT OF MANDAMUS to declaring the action of the respondent No. 3 herein in interfering in civil dispute and harassing the petitioners at the behest of unofficial respondent herein as illegal, arbitrary and unconstitutional and consequently direct the respondent No. 3 herein not to harass nor call upon the petitioners to the police station in connection with the said civil dispute and pass such other order or orders as are deem fit and proper in the circumstances of the case." The 3rd respondent filed a counter affidavit stating that the 4th respondent herein filed a suit in O.S.No.

196 of 2015 on the file of the Court of Senior Civil Judge, Bhimavaram against the petitioners herein seeking declaration that the 4th respondent is the absolute owner of the plaint schedule property of item Nos.1 and 2. An application seeking temporary injunction was also filed in I.A.No.760 of 2015, wherein status quo order was granted on 31.07.2015. However, on 09.10.2015, on receipt of communication over phone regarding galata between the petitioners and 4th respondent at the subject-property, the 3rd respondent, with a view to prevent any commission of offence, deputed his staff in Vissakoderu village with instructions to act according to the situation warranted. Thus the 3rd respondent has taken steps as per law and advised the parties to maintain status quo as ordered by the civil Court.

Having regard to the said facts, this Court is of the opinion that no further orders are required in the writ petition. Accordingly, the writ petition is closed. No costs. Pending miscellaneous petitions, if any, shall stand closed. ___________________ P.KESHAVA RAO,J 06th DECEMBER 2018.
