THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM CRIMINAL PETITION No. 3382 of 2019 O R D E R:

This petition is filed under Section 482 of the Criminal Procedure Code by Accused Nos.1 to 5 in Crime No.114 of 2019 on the file of the Station House Officer, Sattupally Police Station, Khammam, seeking quashing of proceedings in the said crime, registered for the offences punishable under Sections 419, 420, 426, 447and 506 (2) IPC read with Section 34 IPC.

Prima facie, the complaint itself points out that non-implementation of the development agreement is the dispute between the petitioner and respondent No.2. In other words, essentially, the said dispute is of civil nature. However, since the investigation is not yet completed, this Court is not inclined to quash the proceedings in the above-said crime.

Hence, the Criminal Petition is disposed of, directing that the investigation may go on, but however, the petitioners shall not be arrested till filing of the charge sheet.

Consequently, miscellaneous applications, if any shall stand disposed of.
