THE HON'BLE SRI JUSTICE P.NAVEEN RAO ORDER:

Petitioner alleges that one Smt. Ashruf Unnisa Begum preferred an appeal under Section 5 (5) of the Telangana Rights in Land and Pattadar Passbooks Act, 1971, against the decision of Tahsildar, dated 23.03.2013, concerning the land to an extent of Acs.185.32 guntas in Survey Nos.71/7, 71/2 and 71/3 situated at Sahebnagar Kalan, Hayathnagar Mandal, Ranga Reddy District. 2.

It appears that the said Ashruf Unnisa Begum died on 01.04.2015. In June 2018, learned counsel for the appellant in appeal vide R.O.R.No.2857 of 2013 sought time to file an application before the Revenue Divisional Officer informing that the appellant in the said appeal died on 01.04.2015 and seven (7) persons whose names were mentioned in the Memo filed on behalf of the appellant are the legal heirs. The present Writ Petition is filed alleging that the said appeal is not being disposed of till date causing hardship.

Suffice to note that the appeal is stated to be pending since 2013. Without expressing any opinion on the maintainability of the appeal after death of Smt. Ashruf Unnisa Begum and delay in filing application to bring legal representatives on record, leaving it to the Revenue Divisional Officer, Ibrahimpatnam, Ranga Reddy District, to take a decision on this aspect and decide the same expeditiously. The entire exercise shall be completed within a

period of two (2) months by assigning reasons and communicate the decision taken thereon to the petitioner. 4.

With the above direction, the Writ Petition is disposed of. Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed. There shall be no order as to costs. ___________________ P.NAVEEN RAO, J JULY 1st, 2019 YVL
