THE HON'BLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.41171 OF 2015 ORDER:
The writ petition is filed by the petitioner seeking a writ of mandamus declaring the action of the respondents 2 to 4 in not taking any action pursuant to the representation dated 27.11.2015 submitted by the petitioner for securing her daughter Shaik Ruhee and her grandchildren from the custody of the fifth respondent herein, who confined her daughter against her will, as illegal and arbitrary and consequently to direct the respondents 2 to 4 to handover the custody of the petitioner's daughter, namely, Shaik Ruhee and her children to the petitioner from the custody of the fifth respondent.
Heard and perused the material.
Learned counsel for the petitioner submits that the fifth respondent married the daughter of the petitioner, that two children are born out of their wedlock, that the fifth respondent is involved in number of criminal cases and that the petitioner is not aware of the whereabouts of her daughter and grandchildren. He further submits that even though the petitioner has made a representation, dated 27.11.2015, to the second and third respondents seeking to know the whereabouts of her daughter and grandchildren and also their conditions, the second and third respondents have not acted upon the representation of the petitioner.
Considering the facts and circumstances of the case, the second and third respondents are directed to dispose of the representation, dated 27.11.2015 and inform the same to the
petitioner as early as possible, preferably within a period of one month from the date of receipt of copy of this order. The writ petition is accordingly disposed of. Consequently, miscellaneous petitions, if any shall also stand disposed of. _____________________ JUSTICE RAJA ELANGO 01.11.2016 pln
