THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI WRIT PETITION No.10391 of 2018 ORDER:
This writ petition, under Article 226 of the Constitution of India, is filed by the petitioner seeking interim custody of his vehicle bearing Registration No.TS 08 EV 2148, which is said to have been seized during the course of investigation into the case in Crime No.34 of 2018 on the file of the Bhongir Rural Police Station, Yadadri Bhongir District. 2.
I have heard the submissions of the learned counsel for the petitioner and of the learned Government Pleader for Home (T.S.). Perused material record.

Learned counsel for the petitioner would submit that the petitioner is not an accused in the said crime and that his vehicle was unnecessarily seized and detained by the police. However, he fairly submits that the seizure of the vehicle is reported to the Additional Judicial Magistrate of First Class, Bhongir.

Learned Government Pleader for Home would submit that the petitioner can as well approach the learned Magistrate concerned for release of the vehicle for interim custody.

Recording the submissions, the writ petition is disposed of reserving liberty to the petitioner to file an appropriate application for release of the vehicle for interim custody, before the learned Additional Judicial Magistrate of First
Class, Bhongir, by following the procedure established by law. It is made clear that in the event the petitioner files such an application, the learned Magistrate shall consider and dispose of the same, within one week from the date of filing of such application, however, in strict accordance with the procedure established by law.
