HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO Crl.M.P.No.4644 of 2015 and CRIMINAL PETITION No.4325 OF 2015 COMMON ORDER:
This Criminal Petition is filed by the petitioners/A1 to A4 under Section 482 Cr.P.C seeking to quash the proceedings in C.C.No.119 of 2012 of Judicial First Class Magistrate, Manuguru, where cognizance was taken for the offences punishable under Sections 498-A and 506 I.P.C and Sections 3 and 4 of the Dowry Prohibition Act.
Heard the learned counsel for the petitioners and the learned counsel for respondents.
Pending the Criminal Petition, the de facto complainant filed Crl.MP.No.4644 of 2015 seeking permission of the Court to compound the offence in the above said C.C.
The de facto complainant and the accused are present before the Court and they identified by their respective counsel and stated that A1 and the de facto complainant want to live happily by drowning their differences and glass over their difficulties including withdrawal of divorce O.P. pending against the wife filed by the husband.
Though the offence under Sections 3 and 4 of the Dowry Prohibition Act are not compoundable under Section 320 Cr.P.C. by invoking Section 482 Cr.P.C. the same are compounded.
Accordingly, Crl.M.P.No.4644 of 2015 is ordered and the Criminal Petition is allowed by quashing the proceedings in C.C.No.119 of 2012 of Judicial First Class Magistrate, Manuguru and the bail bonds of the accused shall stand cancelled.
