HON'BLE SRI JUSTICE C.PRAVEEN KUMAR WRIT PETITION No.37172 of 2016 ORDER:

Heard the learned counsel for the petitioner and learned Government Pleader for Revenue and, with their consent, the writ petition is disposed of at the admission stage.

The relief sought for in this Writ Petition is to declare the action of respondent Nos.1 and 4, in threatening to dispossess the petitioner from his peaceful possession and enjoyment of land in Sy.Nos.41-E.2A/1, 1691-1, 1691-2A, 1692-1A, 1741-7A, 49/5, 1695-2B, 1747-3, 1748-1, 1748-4, 1749-13, 1749-15, 1716-17B, 1854-3, 1787/1 and 1785/B1 admeasuring Ac.0.62, 0.02, 1.00, 0.31 0.07, 0.81, 1.31, 0.02, 0.08, 0.07, 0.07, 0.08, 0.03, 0.01, 0.04, 0.04 and 0.82 cents situated at Kothapalem Village, Kota Mandal, SPSR Nellore District, as being illegal and arbitrary.

consequential direction is sought to the respondents not to dispossess the petitioner from the subject lands except in accordance with law.

The petitioner claims to be absolute owner and possessor of the aforesaid lands. It is his grievance that, though the revenue records reflect the name of his father, respondent No.4 is threatening to dispossess him from the subject lands. Hence the Writ Petition.

Learned Government Pleader for Revenue, on instructions, would submit that the subject lands are the private lands of the petitioner; that the petitioner has disputes with third parties with regard to the said lands; and that respondent No.4 never interfered with the said lands.

In view of the statement made by the learned Government Pleader that respondent No.4 never interfered with the property and that there exists disputes with the third parties, ends of justice would be met if the submission of the Learned Government Pleader for Revenue that respondent No.4 is not interfering with the petitioner's possession is recorded.

The Writ Petition is, accordingly, disposed of. The Miscellaneous Petition pending, if any, shall also stand disposed of. However, in the circumstances, without costs. C.PRAVEEN KUMAR,J Date:21.11.2016 usd
