THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No. 3284 of 2022 ORDER:

This Criminal Petition under Section 438 Cr.P.C. is filed by petitioners/accused Nos.7, 9 & 10 seeking bail in the event of their arrest in connection with Crime No. 106 of 2022 on the file of Golkonda Police Station, Hyderabad, registered for the offences punishable under Sections 22(c), 27 r/w.8(c) of NDPS Act, 1985. 2.

The allegations against the petitioners is that they are arrayed as accused on the basis of confession of Accused No.1 in the said crime that these petitioners purchased drugs from him.

As seen from the confession, these petitioners are consumers and accordingly charge against these petitioners would be under Section 27 of the NDPS Act, only.

In the said circumstances, the petitioners are granted anticipatory bail subject to the following terms and conditions:

1) The petitioners/ accused Nos.7, 9 & 10 are directed to surrender before the Station House Officer, Golconda Police Station, Asif Nagar Division, Hyderabad, and on such surrender, the said Station House Officer shall release the petitioners/ accused Nos.7, 9 & 10 on bail on their executing a personal bond to the tune of Rs.10,000/- (Rupees ten thousand only) each with two sureties to the like sum each to his satisfaction.

2) The petitioners shall undertake the test required and also file an affidavit in accordance with Section 34 as sought by the police.

3) The petitioners/ accused Nos.7, 9 & 10 shall abide by the other conditions stipulated in Section 438(2) Cr.P.C and co-operate with the Investigating Officer in investigating the case.

4) The petitioners/accused Nos.7, 9 and 10 shall attend the concerned police station as and when required.

Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
