THE HON'BLE SRI JUSTICE M.S.K.JAISWAL CRIMINAL PETITION No.10808 of 2016 ORDER:

This criminal petition is filed against the order of issuance of non-bailable warrant against the petitioner/accused in S.T.C.No.28/2015 (old STC No.45 of 2012) on the file of the Special Magistrate, Madanapalle, Chittoor District, vide docket order dated 17.12.2015.

Heard both sides.

Having regard to the facts and circumstances of the case, I am not inclined to quash the impugned order. However, it is open for the petitioner/accused to surrender before the Court below within a period of one month from today and file appropriate application to recall the warrant. In such an event, the Court below shall dispose of the said application on the same day on which it is filed on reasonable terms, in accordance with law.

The Criminal Petition is accordingly disposed of. Pending miscellaneous applications, if any, shall stand closed in consequence.
