THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.7992 of 2016 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:

"to issue writ of Mandamus to declare the inaction of the respondents particularly 2nd respondent in disposing off the appeal of the petitioner against the removal order of the 3rd respondent ttateelas illegal, unjust, arbitrary, dilatory and against the legitimate expectation and against Article 14 and 16 of the Constitution of India and consequently direct the 2nd respondent to dispose of the appeal filed by the petitioner latestly by way of representation dated 25.02.2016."

Heard Sri L.J. Veera Reddy and L. Renuka Rani, learned counsel for the petitioner and learned Government Pleader for Panchayat Raj for respondents.

According to the petitioner, the 3rd respondent - the Project Director passed an order, dated 26-07-2015, terminating the petitioner from the post of Field Assistant and as against that the petitioner filed appeal/representation on 25-02-2016 before the 2nd respondent - the District Collector and the same is pending consideration and no orders have been passed on the same. Having regard to the nature of controversy and in the facts and circumstances of the case, this Court is of the considered opinion that ends of justice would be met if the 2nd respondent is directed to pass appropriate orders on the representation/appeal, dated 25-02-2016 said to have been filed by

the petitioner, in accordance with law, by fixing some timeframe. For the aforesaid reasons, the writ petition is disposed of, without expressing any opinion on the merits and demerits of the matter and entitlement of the petitioner, directing the 2nd respondent to consider and pass appropriate orders on the representation/appeal, dated 25-02-2016 said to have been submitted by the petitioner herein, in accordance with law, within a period of two (2) months from the date of receipt of a copy of this order.

Miscellaneous Petitions pending, if any, shall stand closed. There shall be no order as to costs.
