Heard counsel for the petitioner, the Government Pleader for Agriculture appearing for 1st respondent and Sri Thimothi, Standing Counsel appearing for respondents 2 and 3. 2.

Petitioner has filed this Writ Petition challenging the action of the respondents in not regularizing his services against available vacancies in 2nd respondent on the basis of his seniority as on 03.01.2015 without including the service rendered by the petitioner when he was a boy in accordance with G.O.Ms.No.212, dt.25.11.1993.

Counsel for the petitioner placed reliance on the judgment dt.02.09.2013 in W.P.No.23957 of 2009 wherein this Court directed the respondents to consider regularizing services of the similarly placed persons disregarding their minimum age as on the dates of their joining into service as casual labourers in the event they are otherwise found covered by G.O.Ms.No.212. 4.

Both the counsel state that this judgment would apply to the present case.

Therefore, this Writ petition is disposed of directing the respondents to consider the case of the petitioner in the light of the judgment dt.02.09.2013 in W.P.No.23957 of 2009 within a period of eight (08) weeks from the date of receipt of a copy of this order. There shall be no order as to costs.

Consequently, miscellaneous petitions pending, if any, in this Revision shall stand closed.
