HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.2165 OF 2017 ORDER:

This writ petition is filed for a writ of mandamus declaring the action of the 3rd respondent in seizing the bore well vide proceedings in Rc.No.B/528/2016, dated 11.01.2017, as illegal and arbitrary.

Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Revenue.

Admittedly, an appeal lies against the impugned order and the same is not disputed by the learned counsel for the petitioner. In view of the same, I am not inclined to entertain the writ petition. Accordingly, the writ petition is dismissed granting liberty to the petitioner to avail alternative remedy available under law. Since it is stated that there is a standing crop, there shall be stay of impugned proceedings for a period of three (03) weeks from today. There shall be no order as to costs.
