HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.9686 OF 2017 ORDER:
This writ petition is filed for a mandamus declaring the action of respondent No.2, in not passing orders for release of 2100 Kgs of white jaggery (wrongly mentioned as black jaggery), as being illegal and arbitrary. The petitioner pleaded that, during the course of purchase and sale of Kirana items, he purchased 2100 Kgs of white jaggery under bill dated 11.11.2016 and loaded in Bolero Van; and, when it reached near Dardhepally to Kondapur Road, respondent No.3 intercepted the vehicle, seized the stock and registered the case in C.O.R. No.227/2016. The petitioner, therefore, seeks a direction to respondent No.2 to pass orders on his application dated 06.03.2017 to release stock seized in C.O.R. No.227/2016. Heard the learned counsel for petitioner and learned Government Pleader for Prohibition and Excise.
Inasmuch as the application seeking release of seized stock is pending with respondent No.2, interest of justice would be served if a direction is issued to respondent No.2 to dispose of the petitioner's application dated 06.03.2017 within a period of four weeks from the date of receipt of a copy of this order.
Subject to the above direction, the writ petition stands disposed of.
Consequently, miscellaneous petitions pending, if any, shall stand disposed of as infructuous. No order as to costs.
