THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI S.A.M.P.No.198 of 2015 and S.A.No.148 of 2002 JUDGMENT:- Second Appeal No.148 of 2002 has been filed by the unsuccessful defendant, assailing the decree and judgment dated 27.09.2001 of the Additional District Judge, Medak at Sangareddy, passed in A.S.No.47 of 1996, whereby, the learned Additional District Judge, while dismissing the said appeal, had confirmed the decree and judgment dated 31.08.1996 of the learned Principal District Munisif at Sangareddy, passed in O.S.No.140 of 1989.

2. Now, S.A.M.P.No.198 of 2015 has been filed by both the parties along with the memorandum of compromise praying to record the compromise entered into by them and to dispose of the second appeal in terms of the said memo of compromise.

3. At hearing, learned counsel for both the sides submit that the parties have amicably settled the matter out of Court and that the terms and conditions of the compromise are reduced into writing by way of joint memo which is also filed into the Court and request to dispose of the appeal by recording that the matter is settled out of Court, as the parties have not appeared before the Court for admitting the terms and compromise.

4. Recording the said submissions, the second appeal is disposed of as settled out of Court and observing that no cause survives for adjudication in this second appeal. There shall be no order as to costs. Miscellaneous petitions pending, if any, in this appeal shall stand dismissed. _____________________
