THE HON'BLE SRI JUSTICE SURESH KUMAR KAIT AND THE HON'BLE SRI JUSTICE N. BALATYOGI FAMILY COURT APPEAL No.19 OF 2015 ORDER: (Oral) (Per Hon'ble Sri Justice SURESH KUMAR KAIT) Vide the present appeal, the appellant has challenged the common order dated 14.07.2010 passed in O.P.No.300 of 2007 on the file of Judge, Additional Family Court, Visakhapatnam, whereby judicial separation between the appellant and the respondent has been granted.

2. The appellant and the respondent are present in the Court in-person with their respective learned counsels.

4. It is mutually agreed by the appellant and the respondent that let matter of matrimonial life comes to an end by granting divorce by this Court.

5. Learned counsel appearing on behalf of the respondent, on instructions, has no objection, if the divorce is granted as filed before the trial Court on mutual consent.

6. The respondent does not contest the present appeal and submits that the only litigation expenses may be granted in her favour.

7. Both the parties have agreed to withdraw all the allegations made against each other.

8. In view of the settlement arrived at between the appellant and the respondent, we hereby dissolve the marriage between them by mutual consent.

9. We hereby made clear that the allegations made against each other during the legal battle shall not come in the way of either of the parties under any circumstances in future.

10. Accordingly, the Family Court Appeal is disposed of. The appellant shall pay an amount of Rs.10,000/- (Rupees ten thousand only), as litigation expenses, in favour of the respondent within two (02) weeks from today.

Miscellaneous petitions, if any, pending shall stand closed.
