THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO CONTEMPT CASE No. 857 of 2017 ORDER:

This contempt case is filed alleging non-implementation of the order, dated 11.07.2016, passed in W.P.No.5757 of 2016. Relevant portion of the order, dated 11.07.2016, reads as under:

"The petitioner submits that respondent No.1 should issue necessary clarification to the Commissioner, Panchayat Raj & Rural Development Department, who in turn shall issue instruction to respondent Nos.2 and 3 for making the balance payment, pursuant to the sanction orders of respondent No.2, dated 21.07.2015.

The said issue was not clarified in the counteraffidavit filed on 26.03.2016 on behalf of respondent No.1.

In the circumstances, respondent No.1 is directed to look into the above communications and pass appropriate orders thereon within three months from the date of receipt of a copy of this order, pending further orders in the writ petition."

Now, the petitioner himself produced before this Court a copy of Memo No.2293/Vig.III/A1/2016-4, dated 31.01.2017, issued by the Government to the Commissioner, Panchayat Raj & Rural Development, directing him to pay the pension with interest at 9% per annum from 01.07.2011 by

implementing the orders of the Hon'ble Supreme Court dated 06.05.2014.

The petitioner-in-person submits that in spite of issuance of the said Memo, no payment is made. That issue is beyond the scope of the present contempt case and it is open to the petitioner to urge the same point in the pending writ petition. This Court does not see any ground to continue the present contempt proceedings.

The contempt case is accordingly closed.
