HON'BLE SRI JUSTICE R. KANTHA RAO Writ Petition No.15190 of 2015 ORDER:

This writ petition is filed seeking writ of Mandamus declaring the action of the 3rd respondent in suspending the petitioner from services vide orders dated 27.04.2015, as illegal and arbitrary.

2. Heard the learned counsel appearing for the petitioner and the learned Special standing counsel for MGNREGS.

3. The petitioner, who is the Field Assistant, was suspended by the 3rd respondent vide orders dated 27.04.2015 on the allegation that the petitioner was responsible for the misappropriation of Government funds by disbursing a sum of Rs.30,000/- to the work of constructing toilets, which relates to the year 2014 and claimed expenses as if it was newly constructed. Learned counsel appearing for the petitioner submits that the petitioner has nothing to do with the disbursement of the amount and therefore, the suspension is illegal. On the other hand learned Special standing counsel for the MGNREGS, submits that the issue involved in the writ petition requires enquiry in to the controversial facts and therefore, an enquiry needs to be conducted.

4. Considering the submissions made on either side, the 3rd respondent is directed to conduct enquiry in to the allegations levelled against the petitioner and pass final orders within a period of four weeks from the date of receipt of a copy of this order.

5. The writ petition is accordingly disposed of at the stage of admission. Miscellaneous petitions, if any, in this writ petition shall stand closed. No order as to costs.
